10.10 Other written evidence 其他书面证据

If the applicant provides a written explanation and supporting documentation in lieu of test results, officers must assess it against the Canadian Language Benchmarks 2000, and/or the Standards Linguistiques Canadiens 2002.

    如果申请人没有提供语言考试的成绩，而是提供书面证据来证明其语言能力，移民官应该按照加拿大的 the Canadian Language Benchmarks 2000的标准，或者/并同时按照Standards Linguistiques Canadiens 2002的标准来评估他的语言能力。

The onus is on the applicant to satisfy the officer of claimed language proficiency. Although it is expected that local knowledge will be invaluable in developing language proficiency profiles, the following guidelines are intended to assist officers in making language proficiency decisions.

    申请人自己有举证责任，证明他具有他声称的语言熟练程度。当然，移民官对于其驻在国的语言使用的情况的了解是很有用的。但是，这里我们也提出一些原则，以帮助移民官就语言能力作出评定：

• Where the applicant has been raised, educated and employed in an environment where one of
the official languages is in predominant use, a written explanation will usually suffice to
establish high proficiency in that language.

• 如果申请人是在一个以英文或法文为主要语言的环境里长大，接受教育和工作的，一份书面的说明基本就能证明申请人的语言熟练程度了。

• In situations where an applicant may claim some expertise in an official language primarily
through education and/or employment, officers will make use of knowledge of local conditions
to assist them in assessing the validity of such claims. This knowledge may be enhanced by
regular liaison with local chapters of approved language testing organizations, who may have
developed, over time, clear indicators and profiles of English / French proficiency in that locale.

• 如果申请人自称其语言能力主要是通过其教育加上工作，或者是教育或工作中的其中一个途径掌握的，移民官应根据他对当地情况的了解，对申请人的自称的语言能力作出判断。移民官可以与当地的了解本地居民的语言能力的语言考试机构沟通，以增加其对当地的语言水平的了解。

• Given the detailed nature of the Canadian Language Benchmarks and the Standards Linguistiques Canadiens, it should be clear that, in most cases where language proficiency is not patently obvious from the applicant’s background, self-serving declarations, third party testimonials and/or other claims not supported by detailed and objective evidence will be of little probative value in establishing high or moderate proficiency.

鉴于“Canadian Language Benchmarks” 和 “Standards Linguistiques Canadiens”这两项语言能力标准的手册对语言能力衡定的标准是很具体的。因而，切记，在大部分情况下，如果申请人的背景并不能明白表明他的语言熟练程度，则，光凭申请人自己的宣誓书、第三方的推荐信或其他的文件，而没有具体的、客观的证据相佐证，对于证明他的语言熟练程度是没有什么用处的。
